Alimony or Spousal Support

Alimony or Spousal support and alimony pendente lite (translated from the Latin as alimony pending litigation) are determined and governed by both Pennsylvania statute and the Pennsylvania Rules of Civil Procedure as well as numerous cases decided in Pennsylvania.

Alimony pendent lite is paid prior to the entry of a decree in divorce and alimony is paid after the decree is entered or by agreement of the parties.

Alimony is calculated after consideration of equitable distribution of marital assets and liabilities.

Alimony normally takes the forms of regular payments that one spouse makes to the other in order to provide financial support during and or after a divorce. Alimony may paid through an agreement of the parties either before, during or after the marriage.

The general rule of the Pennsylvania Divorce code is that where a divorce decree has been entered the court may allow alimony as it deems reasonable. This allows the court a considerable amount of leeway to determine the amount of alimony.
